Hawaii Criminal and Family Defense Lawyer
As a former prosecutor I know the ins and outs of the criminal justice system and use that knowledge and experience to aggressively and passionately help every client I represent. For many years I travelled the United States and Europe as the spouse of a military officer. While I have represented the Immigration and Naturalization Service and prosecuted cases for the District Attorney’s Office, my most important and satisfying work is defending my clients in criminal matters, operating under the influence cases, and divorce/paternity proceedings.
OUI sentencing in Hawaii can be very harsh and in 2010 will become much harsher. Your case could greatly benefit from the help and experience of a seasoned defense attorney. Cynthia L. Sims will work tirelessly on your behalf in order to help enhance your chances of a positive outcome in your case.
Consultations are always free. Call or email today! :-)

Hawaii Drunk Driving Defense Lawyer
Have you or someone you know been arrested for Operating Under the Influence? If the answer is yes, then you most definitely need to call me. Between breathalyzer tests, blood alcohol tests, and field sobriety tests, getting your OUI charge dropped or dismissed may seem hopeless. As an experienced Hawaii DUI/OUI Defense Attorney, I have seen many alternative outcomes to an OUI charge, and many occur as the result of a thorough examination of evidence. If you failed any of the different types of sobriety tests, it does not mean your case is over. There are many options to be explored. Contact me so we can explore these options together.
If you have been arrested for Drunk Driving in the State of Hawaii, you can expect to be involved in two proceedings. The first criminal proceeding begins when you are arrested and can affect the overall outcome of your DUI case. The second is a civil proceeding which will be conducted with the Motor Vehicle Division (MVD) and determines whether or not your license will be suspended. Both proceedings are important to the outcome of your case, but do not necessarily affect one another. It is important that you have a Hawaii OUI Lawyer by your side throughout the proceedings to protect your rights.
In the state of Hawaii, a DUI/OUI conviction can result in harsh penalties such as jail time, large fines, and probation. Depending upon the nature and extent of your OUI charge, you could lose your driver’s license for months, years, and in some cases forever. You will, if convicted, pay substantially more for your vehicle insurance for many years, may not be able to drive commercially, potentially for life. In addition, you will have a record -- future employers will search and access; this could limit your future employment opportunities. You don’t have to face your OUI/DUI charges alone, and by hiring a qualified and experienced Hawaii OUI attorney you will have the legal support you need.
Family Law
I take family law cases with special expertise in military cases. I offer divorce, child custody, and child support representation. My practice is client focused in order to offer personalized representation. A family law case is the most stressful legal situation that most will ever face. I have the experience to guide you through the process and guide you towards reaching the result you want.
Experience
After many years representing the government in family court, criminal court, the Immigration and Naturalization Service, and most recently as Deputy Prosecuting Attorney, I have established my own practice, concentrating in these areas: Criminal Defense, DUI/OUI Defense, Immigration and family law.
Deputy Prosecutor
Daily representation before District Court Judges. Prosecution of Misdemeanors and Petty Misdemeanors; specifically, Driving While Intoxicated, Assault, Theft, Criminal Trespass, Traffic Crimes and Violations. Court appearances for Arraignment and Plea, Pre-trial Conferences, Motions Hearings, and Trials with Sentencing.
Responsible for investigating and charging decisions; interviewing law enforcement, victims, complaining witnesses and government officials. Trial preparation, including evidence gathering, police and victim preparation.
My time as a Prosecutor proved to be very valuable, and as a criminal defense attorney I am able to see both sides of a case and as a result can provide a more effective defense strategy.
Family Court
I have the experience that will expedite your needs. I was a Honolulu Family Court law clerk and have experience and personally know the people in Family Court that adjudicate divorce, child support, custody, adoption, guardianship and juvenile matters. I know the courts, judges and the personnel that process the legal papers -- I know it will be done right the first time.
Military Family Issues
I have been married to a U.S. Military member for many years. I have traveled the world and know the unique challenges and rewards of government and military life. If you or your spouse are in the Military, I know all the issues and your rights regarding retirement, survivor benefits, TSP, PCS/leaving the state, deploying, child support and much more.
Homeland Defense and Immigration and Naturalization
Prior to moving to Hawaii I was a Homeland Defense and Immigration and Naturalization employee. I know the internal processes of the investigators, adjudicators, central site processing centers and the federal court systems. I know the systems and techniques used by interviewers. I can help you prepare for your interview!! Before you file your forms, or write letters call me and let me review them.
I enjoy helping others and invite you to call me 7 days a week for legal advice and counseling.
